According to the agreement, in March 2012, HSI audited employee I-9 immigration forms at Mary’s Gone Crackers Inc., based in Gridley. Later, in May 2012, HSI notified the company that 49 of its employees appeared not to be authorized to work in the U.S. After one employee provided corrected documentation, Mary’s Gone Crackers informed ICE the other 48 had resigned or been terminated.

In comparison, for fiscal year 2017 – running October 2016 to September 2017 – HSI opened 1,716 worksite investigations; initiated 1,360 I-9 audits; and made 139 criminal arrests and 172 administrative arrests related to worksite enforcement.

On March 19 due to precautions implemented by employers and employees associated with COVID-19, the Department of Homeland Security (DHS) announced that it would exercise prosecutorial discretion to defer the physical presence requirements associated with the Employment Eligibility Verification (Form I-9) under section 274A of the Immigration and Nationality Act. This provision, as explained in the guidance below, was implemented for 60 days and was set to expire on May 19.
