Virginia Beach man pleads guilty to distributing child pornography

NORFOLK, Va. – A Virginia Beach man pleaded guilty Tuesday to distributing child pornography. This investigation was conducted by U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI).

According to the statement of facts, on Nov. 10, 2014, Richard Midgett, 50, used a peer-to-peer file-sharing network to distribute a computer file depicting child pornography.  Later, after his computer equipment was seized during the execution of a search warrant, a forensic analysis of Midgett’s computer showed he possessed approximately 33,000 images and 1,817 videos of child pornography. 

Midgett was indicted by a federal grand jury Sept. 8. He faces a maximum penalty of 20 years in prison when sentenced Feb. 8, 2016. The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes, as the sentencing of the defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors.

This investigation was conducted under HSI’s Operation Predator, an international initiative to protect children from sexual predators. Since the launch of Operation Predator in 2003, HSI has arrested more than 12,000 individuals for crimes against children, including the production and distribution of online child pornography, traveling overseas for sex with minors, and sex trafficking of children. In fiscal year 2014, more than 2,300 individuals were arrested by HSI special agents under this initiative and more than 1,000 victims identified or rescued.
